The lawsuit was initiated by author David Desio, who claims that “Sinking Spring” is fundamentally based on his manuscript, “The Dope Thief.” According to the legal filing, Desio shared his work with author Dennis Tafoya in the mid-2000s. Tafoya later published a book, also titled The Dope Thief, in 2009, which Apple subsequently optioned for the series.
Desio’s claim centers on the assertion that Tafoya’s published book, which serves as the official source for “Sinking Spring,” is a direct appropriation of his original, unpublished work. The lawsuit targets not only Apple and Scott Free but also Tafoya, seeking damages and recognition of copyright infringement.

“Sinking Spring” boasts considerable star power, with acclaimed director Ridley Scott serving as an executive producer and Brian Tyree Henry leading the cast. The series follows two friends from Philadelphia who pose as DEA agents to rob a secluded house, only to find themselves entangled in the East Coast’s largest narcotics trafficking operation. The serious allegations now place this major production under an unwelcome spotlight.
